An old friend told me that someone put up a fence that blocks the access to the rocks on preston Beach Marblehead!! Is that legal ? I didn't think people could own the beach?
Thats also where i landed my biggest striper ever a 43 incher.confused.gif

I don't know I believe if you are below the High Tide line you are legally allowed to be on the waterfront. Check the law before you test it though.

Thanks this property is well away from the water. Theres a retaining wall and everything. you could walk the beach right to the rocks. Seems strange to me.
If its legal i'll just have to move down to devereaux beach instead.

If the fence was put up by the town then you have no chance in fighting it. But if put up by the homeowner I would check with town hall for permits, etc to do that

A fisherman has the right to fish the shoreline provided we stay on the ocean side of the high water line and access the area legally. Increasingly that access is being blocked or pushed further away
