If I happen to scap herring in Kingston, am I allowed to bring them to Marlboro to use as bait? If so, is there a limit to how far I can take them? I was looking over the regulations, but there seems to be some gray area.

This is the Overland Corridor southern boundary and the northern boundary is the Troy Dam. I don't know exactly where Marlboro is so I can't tell you for sure.

"south on the Taconic State Parkway to its intersection with the Sprain Brook Parkway, then continuing south on the Sprain Brook Parkway to its intersection with I-287, then continuing west on I-287 across the Mario M. Cuomo Bridge to I-87 North, then continuing north on I-87"

If you're transporting the bait in the boat this area is all considered the same water body "Hudson River downstream from the Federal Dam at Troy to the Battery at the southern tip of Manhattan Island".

And it looks to me like you're ok anywhere within that water body by boat "Baitfish or other legally taken fish species intended to be used as bait may only be used in the same waterbody from which they were caught for bait in hook-and-line fishing."

That's my take on it.

Thanks for the info. Marlboro is just north of the Newburgh/Beacon Bridge. It's also just south of the Mid Hudson Bridge. I have seen good fish being taken in this area, but I have failed to catch anything myself in the last few years. Someone told me that herring is key for this area, but the dead and chunked herring I used go me nothing but shorts and catfish. I was hoping that live herring would make a difference.
On a side note, I was also told that most stripers are there to spawn and not necessarily feed. This may be why it's so hit and miss. I will keep on trying. Thanks again. I hope everyone has a great season.

Im from poughkeepsie area I fishing from boat and land and your in a great area. Definitely live is the best bait but early season you can catch them with blood worms also.There is a creek right by children museum where you can get live ones later on in the season

Hello to all,

just a heads up, I have been fishing this area for a long time. I use to catch my bait @fall kill trib. Beware to all that dental office will have your car towed and PKPD will hand out tickets.

Technically it is illegal to transport herring over land which is what I was told by DEC but everyone does it…..just don’t get caught. Yes they are here to spawn but make no mistake….before and after they feed like crazy. Generally in Marlboro you will the bigger fish on herring early morning and night.

I think whoever told you that was incorrect. This is right from the DEC site.

  • Personally Collected Baitfish
    Personally collected baitfish taken from a waterbody within an overland transportation corridor may be transported within that corridor. These baitfish may only be used within the same waterbody where they were collected.

From my observations Dec doesn't really bother anybody for transport unless you bought the herring home and then bought it back to the river at that point it can be a Grey area because I've seen them ask people where they got the bait from and if it was bought is it certified and do you have a receipt...it's just like the net laws I've seen Dec enforce the 13x13 size net and I've seen them not say anything it's a roll of the dice ...carry the reg book on ya if you have doubts because I've had to show the rules to some Dec officers that thought they knew what laws were to be enforced and they wer wrong
