Default Netting Regulations

OK - i know the new laws did not pass and netting in the creeks is legal.

I assume you need the marine registration since i would be between the river and the first impassable barrier ..... but i was in the bait store the other day and he told me i needed an additional license to use the net.

Is he right?? i was under the impression that a fishing license and the marine registration were all you needed to throw a cast net under 10 feet to get herring for personal use.

There are regs (not new either, been in place for years) that pertain to the Size of net you are using, doesn't matter if it's creek or main river.

"Alewives and blueback herring may be taken in a dip net not exceeding 14 inches in diameter, or 13 x 13 inches if square"

http://www.dec.ny.gov/outdoor/31416.html

I'm not 100% sure about cast net size.

It only cost $1 per year and you need to track and send in a report to DEC at the end of the year. I have been doing it for 5-6 years now.

the only time you need a the bait license is if you are gonna sell the bait you are catching. that is what i was told bye dec. unless you are using a net bigger than what is allowed . then you would need the special permit

Dip net , 14" , Scap net , 6'X6' , Cast net up to 10' in diameter , no licence needed for Hudson river , N.Y.S. fishing licence required for tributaries . The link above may help you .

The new recreational marine fishing registry is needed in tribs or river for any migratory fishing.

im glad someone started a netting thread, so i didnt have to start something negative. heres my story..... i took my son to the poestenkill to teach him all about herring and the various ways of catching them. i started teaching him to dip with a 14" trout net and stoolie, while i worked a sabiki. well some jack_ss named shaun who was throwing a castnet 20 ft away starts yelling at us and freaking out that we were netting illegally and we were going to be ticketed. i told him it was legal and asked him what was illegal about our netting. he said that the net had to be 14" inches and SQUARE. WRONG AND WRONG! it doent have to be square, and if it is square it has to be 13". he proceeded harass us and told us he has lived there for 30 years and knows all the rules! what a tool . i told my son to ignore him . my son ended up netting 6 herring, and we went to the river to teach him striper set-up. fortunately there were much friendlier people at the river. nice first experience for the kid... some people are unbelievable. i hope shaun is on here, but he probably cant read anyway
