Default Kicked off beach!!!!!!!????? WTF!!!

Down sea isle city, nj bout 1 1/2 hours before low tide I hit the beach I put my stake chop bait clip on a black bomber procede to walk in then I notice to young flash light toters with healy waist lines oh I mean guns walk up tell me what a ya doing fishing? No I'm posing for pictures! So he says can't b on beach after 10pm! WTF! Nuts! This is an outrage! I have to check on the legality of this I got kicked off the beach I'm here typeing on my phone right Now as I should b in the surf! Outrage!!!!! Help me out here!

That shouldn't be legal
Set up a meeting and politely and professionally speak with the Town Administrator and Chief of Police to discuss the situation.
Familiarize yourself with The Public Trust Doctrine before you go. It's also an excellent idea to dress conservatively, khakis and a Polo shirt is fine. Showing up looking like a bum will hurt rather then help the situation.
I had this happen to me recently up this way and following the discussions we have full fishing access again - on the condition we act as the eyes and ears of the police when we're down there and call in any trouble making.

By all means ask for the meeting but don't get your hopes up . . .

In the spring the NJ Supreme Court refused to hear a case between Avalon and the NJDEP about beach access. This left standing the lower court ruling siding with Avalon.

While the case was about parking and restrooms it has the effect of permitting Avalon (and any other shore municipality) to close public access for "reasonable" reasons like "public safety."

Since it is certainly easier to police a beach that is closed to the public such a closure appears legal under the ruling. Expect other cities / municipalities to follow this practice.
