Default MA Cast Net Regs?

I just purchased a 10ft 1 1/8th mesh cast net and I just found out that it might not be legal in MA or I need a permit to use it. Anyone know anything about this or where I can go to get this permit if in fact I am allowed to use it. Thanks for the help

JD

ps How many times have I read Roc's "check with your local regulations" advice and now this.

I was at the DMF today and they told me that there is no reg's for a cast net for bait that is used for personal use. they said that there was no endorsement to add to your permit. I was very clear that i was throwing a large net and they said there was no regs!

REALLY!!! I was told by my bait shop that anything over 6ft you had to have a permit. Anyone know where we can confirm this? I dont even want to know the fine that could come off from using my net. Thanks guys for the help.

From the MA Division of Marine Fisheries website...

Quote:
A person may, without a special permit, use a small net of no more than 200 square feet inside those inshore waters listed in 322 CMR 4.02(2) or inside any estuary, embayment, salt pond, tidal creek, river, or an other similar body of inshore water for the sole purpose of obtaining bait fish for personal use.

That is about a 15' dia. or 7.5' radius for anyone seeking the math. So if it's a 10' radius you are over, which is a big ass net.

The lady was very helpful she even called boston to double check & they even said the regs are very unclear. I guess it just depends who you get on the water and how they read the regs.. What do i know, you think they would specify what kind of net is what so we would all read the reg the same way..

I gotta think that the warden checking you out is going to interpret it this way, "A net is a net whether you pull it or throw it. The regs say net. Is that a net? Yup, that's a net."

At the inshore net meetings, this Winter, the rules were proposed to be liberalized for cast nets, to not permit, or size restriction. The rationale being, how big could a cast net be?

The proposal for recreational gill nets was to have a Square Foot restriction. But that was still undetermined at that time.

I don't know the time table for the rules changes.

I have asked two wardens about cast nets and they both said "cast net used for catching bait for personel use are not restricted, except in spawning waters" and that means posted waters
